Terms of Service

1. Definitions
“SavinEasy,” “we,” or “us” means SAVINEASY DIGITAL SERVICE INC, operating the SavinEasy service.
“User,” “you,” or “your” refers to anyone accessing the website or app.
“Services” means the SavinEasy website, mobile app, and related features (price comparison, meal-planning, savings tools).
“User Content” means any information, recipes, photos, or other material you submit to the Services.
“Subscription” refers to any paid recurring plan for access to premium SavinEasy features.
“Effective Date” means the date this Agreement is enforced, shown below.
Other capitalized terms are defined in context.
2. Use of the Service and Accounts
You must be 16 or older (or have parental consent if younger). To use certain features, you may create an account with a valid email and password. Keep your credentials secure; you are responsible for all activity under your account. You agree to provide accurate information and promptly update changes.
3. Subscription and Payments
SavinEasy may offer subscription-based access. By subscribing, you authorize recurring billing (e.g. monthly charges) via your chosen payment method. All subscriptions auto-renew until you cancel. Payment terms (pricing, trial periods, cancellation process) are displayed at checkout or in your account. Refunds (if any) are at SavinEasy’s discretion; policies will be posted on the site. Cancellations: You can cancel online; cancellations take effect at period end. SavinEasy may suspend access for non-payment. Payment data is processed via secure third-party processors; SavinEasy does not store full credit card details.
4. User Content and License Grant
Users may submit content (e.g. shopping lists, recipes, reviews). You retain ownership of your content, but by posting you grant SavinEasy a non-exclusive, perpetual, worldwide, royalty-free license to use, modify, and display it in connection with the Services. You represent your content is yours (or you have rights to it) and doesn’t violate laws or third-party rights. SavinEasy may remove or refuse any content at its discretion.
5. Information Accuracy & Disclaimers
Informational Purpose: The SavinEasy Services provide information (prices, deals, meal suggestions) for convenience only. SavinEasy is not affiliated with or endorsed by any retailer. We do not guarantee it is complete or up-to-date.
Pricing Accuracy Disclaimer: Product prices and promotions displayed on SavinEasy are compiled from publicly available sources and may change without notice. SavinEasy is not affiliated with or endorsed by any retailer. In all cases, verify prices and offers directly with the retailer.
No Retailer Affiliation: SavinEasy is an independent platform not endorsed by or affiliated with any grocery retailer. We aggregate publicly available data (flyers, coupons) for users’ convenience.
6. Intellectual Property
All content and software on SavinEasy (including logos, design, code, images, text) are owned by SavinEasy or its licensors and are protected by copyright, trademark, and other laws. All content, software, design and branding are the intellectual property of SavinEasy. “SavinEasy” and related marks are trademarks of SAVINEASY. Nothing in this Agreement grants you any rights to our IP except the limited license to use the Services.
7. Acceptable Use
You agree not to use the Services to:
- Violate laws or any third party rights;
- Share infringing, defamatory, obscene or illegal material;
- Attempt to probe, scan or test vulnerabilities of the Service;
- Disrupt or abuse the Service (fraudulent or spam activities);
- Bypass any access controls.
SavinEasy reserves the right to block or remove content or suspend accounts for violations.
8. Third-Party Links and Ads
SavinEasy may contain links to third-party websites (e.g., retail websites). These are for convenience only. SavinEasy does not control or endorse third-party content and is not liable for it. Advertisements or sponsors (if any) are not SavinEasy’s responsibility. Use third-party links at your own risk.
9. Privacy, Cookies, and Consent
Your privacy is governed by our Privacy Policy at /privacy-policy. The Policy explains how we collect, use, and share your personal data under PIPEDA. We also comply with CASL (e.g. you must opt in for marketing emails). SavinEasy uses cookies and analytics; details are in the Privacy Policy. By using the Services, you consent to our data practices described there.
10. Retailer Data and Opt-Out
SavinEasy sources price and promotion data from retailers’ public flyers and sites. We only use factual data (product names, prices, sizes, dates). We do not copy copyrighted creative elements (flyer images, logos, layouts). Retailers may contact SavinEasy to request corrections or removal of promotional data. If you are a retailer and wish SavinEasy to stop using your data, contact us at support@savineasy.ca. We will review and remove data as required by law.
11. Indemnification
You agree to indemnify and hold harmless SavinEasy and its affiliates (and their officers, directors, employees) from any claims arising out of your violation of this Agreement or your misuse of the Services (including infringement claims from your content). This obligation survives termination.
12. Limitation of Liability and Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW: SavinEasy, affiliates, and suppliers disclaim all liability for any indirect, incidental, special, or consequential damages (e.g. lost profits, data loss) related to the Services. Even if advised of the possibility of such damages, none shall be awarded. Our total aggregate liability for any claim arising under this Agreement is limited to CAN$100 or the amount you paid in the last 12 months, whichever is less.
No action (including a class action) may be brought more than one year after the cause of action arose. You waive the right to trial by jury to the extent permitted by law.
13. Dispute Resolution
Governing Law: This Agreement is governed by the laws of the Province of Ontario and Canada, without regard to conflict of laws rules.
Arbitration: Any dispute will primarily be resolved by binding arbitration in Ontario, Canada. You may opt out of arbitration by notifying SavinEasy within 30 days of first acceptance of this Agreement (details are in our Privacy Policy). Small claims in your home province court remain available for claims under CAD 35,000.
Injunctive Relief: Notwithstanding arbitration, SavinEasy may seek injunctive or equitable relief from courts to protect its IP or confidential information.
14. Compliance with Laws
You will comply with all applicable laws (e.g. exporting technology, data protection). SavinEasy services may not be available in all jurisdictions. By using the Services, you represent that you are not located in a restricted country.
15. Termination
We may suspend or terminate your access at any time for any breach of this Agreement. On termination, all licenses granted to you are revoked and you must stop using the Services. Sections 5, 6, 11-21 (all except use and account clauses) survive termination.
16. Changes to Services or Agreement
SavinEasy may modify or discontinue the Services (or any part) at any time. We may also modify this Agreement (with 30 days’ notice via the app/website). Continued use after changes means you accept the new terms.
17. Notices and Consent
Notices to SavinEasy should be sent to info@savineasy.ca. SavinEasy may contact you by email or via the app for notices. By agreeing to this TOS, you consent to receive notices electronically.
18. Assignments
This Agreement is binding on your heirs and assigns. SavinEasy may assign its rights or delegate duties to affiliates or in the event of a merger or sale.
19. Entire Agreement
This Agreement (including Privacy Policy) is the entire agreement between you and SavinEasy regarding the Services and supersedes all prior agreements. No waiver of any term is enforceable unless in writing by SavinEasy.
20. Severability
If any provision is found invalid, the remainder of the Agreement remains enforceable.
